Please send your letter of support right away to Senator Tom Hayden at
the California State Capitol.

This important bill, the first such legislation in the United States,
would authorize the California State Health Department to review the
scientific literature on the health effects of radiofrequency
radiation, the frequency band used by cellular phones.  This bill would
require cellular telephone retailers to offer a hands-free earpiece or
headset when a cellular telephone or service contract is sold within
the state.   This bill would require cellular telephone manufacturers
to provide and cellular telephone retailers to post a warning sign at
point of sale.

The first round of hearings, before the Senate Health and Human Service
Committee, will be held next Wednesday, March 29 at 1:30 in the
Capitol.  Among the confirmed speakers who will testify are
Dr. Henry Lai  and Libby Kelley, CWTI.

    An act to add Article 6 (commencing with Section 108670) to
Chapter 5 of Division 104 of the Health and Safety Code, relating to
cellular telephones.


         LEGISLATIVE COUNSEL'S DIGEST


    SB 1699, as introduced, Hayden.  Health:  cellular telephones.
    Under existing law the State Department of Health Services is
authorized to commence all proper and necessary actions to protect
and preserve the public health.
    This bill would require cellular telephone retailers to offer a
hands-free earpiece or headset when a cellular telephone or service
contract is sold within the state.
    This bill would require cellular telephone manufacturers to
provide and cellular telephone retailers to post a placard at the
point of sale.  The placard would state the possible health risks
associated with cellular telephones.  In addition, the placard would
be required to advise consumers how to protect themselves against
radiation effects from cellular telephones.
    This bill would require the department to review existing surveys
and research concerning the health effects of cellular telephones.
    This bill would require that unless the department determines that
cellular telephones have no adverse health effects by January 1,
2002, all cellular telephones sold after January 1, 2002, must
include a hands-free earpiece or other device to provide protection
against cellular telephone radiation.
    Vote:  majority.  Appropriation:  no.  Fiscal committee:  yes.
State-mandated local program:  no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


   SECTION 1.  Article 6 (commencing with Section 108670) is added to
Chapter 5 of Division 104 of the Health and Safety Code, to read:

       Article 6.  Cellular Telephones

    108670.  The Legislature hereby finds and declares all of the
following:
    (a) Cellular telephones play a vital role in expanding
communication and information globally and are being marketed at
accelerating rates.
    (b) Recent studies suggest the possibility of links between
cellular telephone use and human health impacts such as brain tumors,
memory loss, and genetic mutations.
    (c) A study funded by the Cellular Telecommunications Industry
Association concluded that cellular telephone service users are at
risk of acoustic neuroma, a benign tumor of the auditory nerve, and
increased risk of neuroepithelial tumors on the outside of the brain.
   The same study found a positive correlation between the amount of
cellular telephone service use and tumor development.
    (d) The federal Food and Drug Administration in October 1999
concluded: "Available science does not allow us to conclude that
mobile telephones are absolutely safe or unsafe."
    (e) It is inappropriate that critical health and safety studies
lag behind the vast expansion of cellular telephone marketing.
    108671.  (a) Retailers shall offer a hands-free earpiece or
headset for sale when a cellular telephone service or service
contracts for cellular telephone services are sold in California.
    (b) Manufacturers of cellular telephones shall provide, and
retailers shall post, an informative placard adjacent to the point of
sale.  The informative placard shall advise consumers that academic
studies show a possible link between cellular telephone service usage
and brain tumors and memory loss and that federal studies are
inconclusive.  The informative placard shall also advise consumers
that a hands-free earpiece or headset provides health protection
against radiation effects from cellular telephones. The informative
placard shall be clearly printed, easily understood, and immediately
visible adjacent to the point of sale.
    (c) The State Department of Health Services shall review existing
surveys and research concerning the health effects of cellular
telephones and adopt regulations or undertake additional research.
    (d) Unless the department determines cellular telephones have no
adverse health effects by the appropriate state and federal
authorities on or before January 1, 2002, all cellular telephones
sold after that date shall include a hands-free earpiece or other
device to provide protection against cellular telephone radiation.
