Gee, who'd of thunk it, huh? A regulatory agency cannot make up its own authority. Wow, what a concept! [Note: FDA v. Brown, 98-1152, 2000, was decided very narrowly, as an agency authority vs. statute case. No Constitutional issues were discussed. That's a shame, too. This could and should have been a very important case.] Sometimes it seems that, even in spite of all those un-American socialists in government, the Court (five on the Court, anyway) is trying to nudge the federal government back towards the Constitution. Those important votes are usually 5 to 4 and sometimes 6 to 3 in favor of the Constitution. If we have a careful new president, judges can be placed on the Supreme Court who will vote strictly for the original intent of the Founding Fathers, which could cause freedom to blossom in this country faster than spring crocuses after the first warm rain. There's much to be done, too. We have thousands of laws, rules and regulations that are totally unconstitutional. Today's federal government is much more oppressive than the British were with the Colonists. And, as history teaches, the Colonists went to war for freedom. Well, we're not quite ready for war yet. We are, however, ready for a resurgence of good old fashioned American-style individual liberty. A vast majority of the American people agree, too. One outward sign is that half of the voting age people are so fed up with government they will not even vote anymore. So, there is a large liberty parade quietly forming. Right now it could be a parade, anyway. Without strong national leadership -- a liberty demanding parade master -- that parade could just as easily turn into a messy demonstration or even a riot. But, Washington does not understand any of this because they are too self-centered. The problem we must overcome is simple to define. It's actually diagrammed right in the Constitution for all to read. And, in a nutshell, here it is: Our Constitution limits the authority of the federal government to do only a few things. They are to accomplish these tasks properly, and then go sit down and shut up. However, since the 1930s, the federal government has taken it upon itself to branch out into regulating everything in our lives from womb to tomb. In fact, they even regulate us while in the womb and the tomb. But, the federal government has no authority do any of that. They illegally took that authority upon themselves by force. That is, those who do not obey, are assaulted by men with guns and either killed or imprisoned. The use of force did not make all those oppressive laws, rules or regulations any more Constitutional. It just shows that many in government are willing to use deadly force to enforce that which they have no Constitutional authority to do. There are a series of very derogatory words for that practice; but never mind. At this point, those words add nothing to our argument. Back in 1918, the federal government wanted to regulate a legal product but realized that it had no Constitutional authority to do so. Therefore, it correctly passed an amendment to the Constitution to legally create the desired authority to regulate the product in interstate commerce. The Eighteenth Amendment gave the government the authority to regulate the transportation and sale of intoxicating liquors. Contrast that with the hundreds of unconstitutional laws and regulations of today. There are no amendments authorizing the federal government to regulate hamburgers, onions, fruit, milk, telephones, automobiles, motorcycles, lawnmowers, electrical power plants, the Internet, vegetables, fish, farm land, labor, transportation, medicine, furniture, entertainment, marshes, bogs, creeks, swamps, birds, bugs, biospheres, mines, aircraft, rivers, traffic speeds, seat belts, airbags, cereal, milk, butter, drinking water, toilets, industry, intrastate commerce, or any property or goods owned by a private person for their own personal use. Because, let's face it folks; a Constitutional amendment stating the federal government has authority to regulate everything in our lives would not pass. Therefore, generally speaking, each of the above items would require a separate amendment to be legally regulated by the federal government. Else, the federal government took the time to shepherd the Eighteenth Amendment past the States for nothing. And, here's yet another interesting Constitutional fact: There are only two "products" mentioned within the Constitution. One, as we pointed out, is intoxicating liquors, which may still be regulated according to the Twenty-First Amendment, just not totally banned. The only other "product" mentioned in the Constitution is our personal "Arms." Our guns. Our own personal arms are the only named product intended to be protected by the United States Constitution against regulation by the federal government. The Constitution instructs the federal government that: "the right of the people to keep and bear Arms, shall not be infringed." Since we're dealing with sneaky people like the Clintons, let's parse that a little: The word "keep" means "to own," or possess. The word "bear" means to "carry on one's person." The words "shall not" are rather easy to understand -- even children would know that there are no "exceptions" included within the term "shall not." The word "infringed" means "encroach on" or interfere with. So, as per the authors of our Constitution, anyway, we may own and carry guns and the federal government "shall not" interfere. Ah, but we also see an unintended limitation in the Second Amendment. Which guns may citizens "keep"? Easy. Those which they can "bear." The reason for our right to keep and bear arms is rather straightforward: Thomas Jefferson instructed that, "the strongest reason for people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government." Daniel Webster later agreed, warning that, "God grants liberty only to those who love it, and are always ready to guard and defend it." It's time we enforce our Constitution. Not with a gun, but with our voices. So, let that Liberty parade commence. Loudly. YES, THE CENSUS IS ABOUT MONEY Every time I hear Al Gore talk about the census, and blame George W. Bush for that which he has zero control, I think of a similarly logically challenged Democrat politician from Detroit. "King Coleman," we used to call him. Coleman Young, Mayor, was his title for about twenty long years. Coleman Young is the type who made third world dictators look honest and swore like an inner-city gang banger -- even in public. For instance, somewhere along the line, presidential candidate Jimmy Carter advocated the "ethnic purity" of neighborhoods during the campaign. Carter came to Detroit and was going to apologize to Young but didn't quite get the chance. Young told him (removing all the expletives for publication): [just] "Get up off your knees and keep on walking." Coleman Young went on a trade mission to Japan. About the only quote we can print in this family publication came when the Japanese host, wearing a kimono, performed a 400 year old warrior dance with spear and fan. Coleman Young looked at him and laughed. "I hate to disillusion you, but I can't dance and I can't sing. And, I don't like watermelon, either." When we remove the string of expletives Young often used publicly to describe President Ronald Reagan, all that is left is "President Pruneface." And such were the rantings of Detroit's Mayor Coleman Young on the evening news, year after year. The whole of the Young administration was so corrupt they were often arrested, charged and convicted in groups. The FBI had a lot on Young and could have arrested him at any time. But, they feared a riot, so did not. Consequently, Detroit was stuck with Young until he decided to retire. Needless to say, an awful lot of people left the City of Detroit while Young was mayor. By many counts, nearly half the population left. And, at one point, it was so bad that a popular bumper sticker around the area said, "will the last one in Detroit please turn out the lights." And then, one day, it was census time. Well, Detroit ripped off millions of bucks from the federal government annually because the city was supposed to have a population of nearly one and a half million. If the city fell to less than one-million, that cash flow would be significantly less. And, because of terrible management, out and out theft, pilferage, and whatnot, the city needed every penny it could get. The census only found about 700,000 people, and that included homeless shelters and hospitals. So, Coleman Young came out with one of his famous public rants, laced with expletives, charges of racism and threats of riots. Suddenly, the Washington bureaucracy "averaged in" another 200,000 people for Detroit. However, that was still not the magic number of one million. So, more King Coleman rants, and even stronger threats came forth. Suddenly, those blocks and blocks of dilapidated, burned out slums were said to be populated. Buy federal bureaucratic decree, Detroit was listed with over a million inhabitants. Al Gore, of course, wants to "statistically adjust" actual census headcounts throughout the country. So, he's taunting G.W. Bush about it. "'I want to say to Governor Bush, if you really believe that every American counts, it's time to stand up to the operatives in your own party and support a census that counts every American," Gore said. Evidently, Gore does not seem to realize that he is part of the federal government and Bush is still an outsider. But, that's Al Gore. Stupid. Gore says the old counting method is "outdated." So, he had government cronies say the 1990 count, which "did not use sampling," missed 8.4 million people and double-counted 4.4 million people. Note to Al: Those are huge numbers. So, that would have to have been an intentional miscount -- like in Detroit. In other words, Al, that is fraud. Think about it. Anyway, the Supreme Court nixed Gore's sampling method, at least for the purpose of reapportioning congressional seats in the House. However, the Court left open a possibility that sampling could be used for other purposes -- such as deciding who gets the bulk of federal funds. It's all a big joke, in other words. The actual headcount census may be somewhat correct. But, little else to do with the Census Bureau will be. The entrenched corruption is pervasive in Washington. So, the federal government is even paying broadcasters in targeted areas to deliver the bureaucratic message as part of normal programming. The bottom line is that the Democratic- socialists running the federal bureaucracy will use contrived data as an excuse to be able to dole out favors, in the form of taxpayer money, to any areas of the country that will support their party line the most. (They will also make a lot of money selling the "census" information to businesses.) UN REFORM GROUP & GORE One of the young internationalists groups just sent out a message stating that the Campaign for UN Reform (CUNR) will be offering stipends to assist young people who wish to actively campaign for presidential candidates this summer. http://www.cunr.org That being somewhat interesting, we went to check them out. In their own words, CUNR is working for a stronger United Nations: "The mission of the Campaign for United Nations Reform is to build political will within the United States to promote a more democratic, accountable, and transparent U.N. system; and to increase the resources and authority needed by the U.N. system to achieve the goals set forth in its Charter. Recognizing that U.S. support is essential if the U.N. system is to be strengthened, the role of the Campaign for U.N. Reform is to lobby the U.S. Congress and Administration to take actions to achieve these goals, to make advocacy of a strengthened U.N. system an election issue, and to support the election and appointment of officials who share our vision." So, their goal is to make the strengthening of the U.N. system "an election issue." Therefore, it fits that they want their people involved in the presidential campaign. And, even though a young group (founded in 1996), the groups boasts that they had "177 endorsed candidates win in the 1998 congressional elections." They also say they (CUNRPAC) "contributed close to $28,000 to some 25 campaigns, of which close to 2/3 won." This year, in addition to the House races in which they were involved in 1998, they plan to help in a number of Senate races. And, of course, they plan to pay "volunteer" interns to help out in the presidential campaign. The presidential campaign they will pick to help is easy to guess, too. The only two candidates mentioned on their web page are Gore and Bradly. So, they will obviously contribute money and warm bodies to the Gore campaign. One point of interest on the CUNR web page is more in what's missing than what is there: They do not ask for donations -- nor even hint at donations. So, we went to see where they get their funding and to whom they donate. However, the Federal Election Commission database has no information for either "Campaign for United Nations Reform" or "CUNRPAC." This presents a problem. Where does their money come from? If they are spending to effect election results, we have a right to know. If their funding is coming from the United Nations, or any other foreign concern, we most certainly should know, because that could be illegal. Of course, we are talking about the "no controlling legal authority" Gore campaign here, so that probably makes a difference. Anyway, this group deserves watching -- and close scrutiny by FEC. Now, about those stipends for presidential campaign workers: The published message we received said to contact Don Kraus, the Executive Director at CUNR (202-546-3450 or 1-888-869-CUNR), for more information and to apply. He also has an e-mail address at: [EMAIL PROTECTED] That sounds like an interesting position for some young Republicans. ANOTHER LEGAL SCOURGE The Constitution, being the law of the land, the Clinton administration may truly be about the most corrupt administration in the history of the United States. Like the pigs in George Orwell's Animal Farm, some of today's government officials do things to harm people simply because they want to, and through immoral manipulation of already bad laws and court procedures, they can get away with it. The fact is, they are racists as well as unconstitutional pigs. That's right, gun control is racist. Ask a Polish Jew who is over sixty years old how things could have changed if they were all well armed in Warsaw in the 1930s. Ask a young ghetto mother raising kids alone in New York City or the District of Columbia how she feels totally unprotected in her apartment at night. Gun control, in the United States, started out for very racist reasons: Politicians wanted to disarm the Negros. That done, some government officials decided it would be much more convenient for them if they could be sure that all of the normal Joe Blows on the street were disarmed. So, there came a time when the elite were armed at will, but average urban-dwelling citizens were refused their legal right. The corrupt Clinton administration wants to disarm the whole of the country. But, that's extremely difficult to do legally. So, they are using the despicable legal tricks of the most dishonorable in the legal community to torment gun manufacturers. The unintended consequences are that, to the American people, the fact that this administration's underhanded legal actions might work, loudly punctuates just how corrupt our legal system actually has become. The case in point is the coerced "arrangement" made between a couple administration shysters and Ed Shultz, the chief executive of Smith & Wesson -- a very respected manufacturer. Smith & Wesson happens to be a manufacturer of tools. The "tool" S&W manufactures is called a gun. And, generally speaking, S&W handguns were the handgun of choice for many police departments throughout the country for many years. Quite a number of American citizens also own one or two S&W handguns. They are known as a well made product and S&W revolvers are often passed down from generation to generation. No matter. The authoritarian liberals want the American people disarmed. It won't happen legally. So, they chose to use every vile, underhanded and devious trick in the shyster books to get it done. To wit: Selected liberal public officials around the country conspired to sue handgun manufacturers for the misuse of their product by the end users -- in this case, punks on the streets that these ineffective public officials cannot control. To apply the full force (and unlimited funds) of government, the Departments of Treasury and Housing and Urban Development joined local and state governments in badgering legal gun manufacturers by threatening them with being sued into bankruptcy if they do not kowtow to the socialist- authoritarian (fascist) oppressive wants of big government. Of course, these authoritarians on the far left come by their marching orders from their socialist network. For instance, check out the United Nations International Study on Firearm Regulation at http://www.uncjin.org:80/Statistics/firearms/index.htm. It will not take a lot of reading to see that they want the United States to follow Canada's gun grabbing example. The point is, there is a stated international plan afoot and it definitely includes us. Anyway, as part of the deal imposed on Smith & Wesson, the company shall genuflect before the altar of an all powerful "Oversight Commission" that would include BATF agents, among others. The "Commission" will then have the power of law enforcement over all S&W dealers and S&W gun owners. A S&W dealer may not sell more than one gun to a customer in one day -- the customer would need to wait 14 days to get another gun. And, a customer may not buy from a S&W dealer until they have completed a certified training course. However, to defeat such a vicious and cunning opponent requires courage and perseverance, not capitulation."
