Voters sue over 'election lies'

VOTERS in western Canada are suing to oust the ruling party in British
Columbia for making false election promises in what has been become known as
the "fudge-it budget" scandal.
In seeking re-election in May 1996, the New Democratic Party pledged to
balance the provincial budgets - but then broke its promise.

After a four-year legal struggle, a citizens' group called Help B.C. this
week forced the former provincial Premier and his Finance Minister to
testify in a case that could bring down the provincial government. The
unprecedented lawsuit alleges that politicians fudged the budget in order to
win re-election.

The 1995-96 budget was forecast to run a C$114 million (�49 million)
surplus, but ended up C$355 million in the red. The 1996-97 budget was
projected to be C$87 million in surplus, but had a deficit of C$352 million.

The court action is based on a provision in provincial election law that
makes it illegal to win an election by "fraudulent means".

Help B.C. is asking for three NDP members of the legislative assembly to be
unseated - a move that would cut the party's majority to one and possibly
provoke early elections. The party tried repeatedly to have the action
thrown out of court, but the trial began this month.

Glen Clark, the former provincial Premier who called the 1996 election, said
outside court that he felt no need to apologise for telling voters that the
budget was balanced because he believed it was.
