Elian Abandoned: The 11th Circuit Court of No Appeal

As court arguments were head today in federal court in Atlanta,
one thing is now crystal clear: Elian's Miami attorney's -- led
by Kendall Coffey -- have thrown the case by failing to file key
motions that would have saved the boy.
That's not my opinion, but the opinion of several legal experts.
One such expert is Roger Pilon, now at the distinguished Cato
Institute in Washington, D.C., and formerly an assistant attorney
general in Ronald Reagan's Justice Department.
He granted NewsMax.com an interview this morning regarding the
crucial hearing today in Atlanta on whether Elian Gonzalez is
entitled to an asylum hearing.
As reported weeks ago here at NewsMax.com, Mr. Pilon is the man
who formulated the Justice Department rules interpreting the
rights of minor children to apply for asylum in this country.
Mr. Pilon says the boy has a clear legal right to an asylum
hearing.
But, even more significantly, Mr. Pilon, a lawyer, says the
following: "It is absolutely crucial that the Miami legal team
today raise the issue before this appellate court, not later
before the Miami trial court, of the illegality of the raid
because that raid has created the inability of Elian to meet with
his attorneys.
He can't get due process today without a lawyer having access to
him other than Greg Craig. Janet Reno may have committed
criminal acts in securing a false affidavit and thus a worthless
search warrant under which to conduct the raid. The Atlanta
court can find her in contempt. These issues cannot be left until
the Miami trial court gets the case back again, because if the
11th Circuit decides today that there need be no asylum hearing,
the case is over. Elian is gone. The illegality must be raised
now. No lawyer would not raise these issues."
When this writer merely mentioned the name Kendall Coffey to
begin a question, Mr. Pilon interrupted this writer and said:
"There is a problem with him. He's a Democratic Party operative.
No wonder these issues weren't raised. It's horrible. You have
to wonder whether he's incompetent or compromised."
What wasn't known at the time of the Pilon interview but is known
now is that Kendall Coffey was the actual and only attorney who
presented the oral argument to the Atlanta court this morning on
behalf of the Miami relatives.
Coffey's actions should now leave no doubt for anyone that the
Miami legal team has been hijacked by the Democratic Party and
operatives close to Reno and the Clintons.
[Coffey had been appointed U.S. Attorney in Miami by Reno. --MS]
Donato Dalrymple, a housecleaner, the man who saved the boy, has more
sense and more moxie than the entire legal team around the Miami family.
Kendall Coffey: Reno's man in Miami, doing whatever is necessary to
throw this case. Can "The Fisherman" save the boy yet again, this time
with his friend of the court brief? We shall see.
