Supreme Court Decision Perpetuates Foster Mystery
On Monday the Supreme Court passed up a crucial chance to unravel one of
the enduring mysteries of the Clinton administration when it declined to
consider arguments for the release of key evidence that could explain just
how the Clintons' late Deputy White House Counsel Vincent Foster died.
The media watchdog group Accuracy In Media had filed a FOIA request with
the Park Police to obtain photographs taken of Foster's body after it was
discovered nearly seven years ago in a Fairfax, Va., park.
The Park Service refused to comply, arguing that the release of such
photos would create an unwarranted invasion of privacy for the Foster
family. AIM sued and was represented by the Washington-based public
interest law firm Judicial Watch.
"We're not finished pursuing this," Judicial Watch President Tom Fitton
told NewsMax.com late Monday. "The law is clear. Privacy rights cease at
death." Fitton added, "Accuracy In Media didn't lose here, Judicial Watch
didn't lose, the public interest lost."
In a press release issued after the ruling, AIM Chairman Reed Irvine
called the court's decision "a serious blow to the purposes for which the
Freedom of Information Act was enacted."
Irvine noted that one Park Police photo was of particular interest, since
it could substantiate astonishing observations made by paramedic Richard
Arthur. Arthur was among the first to examine Foster's body and later told
investigators he believed the Clinton lawyer had been murdered.
Arthur made detailed notes as soon as he got back to the Fairfax County
Fire and Rescue Station - at a time when no one could have predicted the
paramedic's observations would be at all controversial. This is how the
veteran EMT described what he saw:
"Gun on his right, laying under his hand. Fingers not curled around.
Barrel end tucked under right leg. 100 percent sure automatic weapon. (Was
in Army, look at magazines, know difference between revolver and
automatic.) Appeared like .45 automatic."
On this point Arthur's notes are starkly at odds with what investigators
later claimed: that the gun found in Foster's right hand wasn't a .45
automatic, but instead a .38 caliber revolver.
But the mystery grows deeper with Arthur's next entry:
"Right side jaw line small caliber bullet hole. (Approximately between
ear and tip of chin) Didn't see any other bullet holes. Obvious DOA....
Didn't look like suicide."
Park Police photographs are said to corroborate Arthur's claims, which
would mean that five federal investigations were wrong when they concluded
that Foster took his own life with a single gunshot into his mouth.
No X-rays exist to contradict the paramedic's eyewitness account. And for
reasons still unexplained, none of the official probes opted to exhume
Foster's body - a move that would have revealed the jawline gunshot wound
Arthur says he saw if it was indeed there.
Monday's Supreme Court decision on the Foster photos means that the
government has passed up yet another chance to discover whether Richard
Arthur's devastating report was accurate.
