I put it before FreeRepublic now because of emails I am getting asking "Where is Judicial Watch?" They are in the vortex of the maelstrom, a most imperfect storm: +++ The Dred Scott decision, handed down by the Supreme Court on March 6, 1857, ruled that a black slave was not entitled to a hearing on whether he could remain in a free state in the North. He was not afforded due process of law because of his color. The decision led to the Civil War. Today, 143 years later, the same Court, this time with a black man sitting on it, is going to decide whether a child is entitled to due process. If not, he will be returned to slavery. Miami's Cuban Americans are braced for this blow as would be a defenseless boxer whose arms are ensnarled in the ropes of the ring that were supposed to fence in a fair fight. Last night, at least when I went to bed, 500 prayer warriors maintained a vigil outside Elian's previous home where, two months ago, this child was taken at the point of a gun in a raid ordered by a woman who never bore a child. I shared their faithfulness with Tom Fitton, Judicial Watch's president, by callling him at work in Washington where, despite the hour, I knew his terriers would be putting the final touches on their emergency petition to be filed this morning in Miami's federal district court. It asks Judge Moore to vacate his order denying Elian an asylum hearing on the basis that our government lied to the judge, that it was, documents clearly now show, collaborating with Castro to subvert our asylum laws, all while maintaining it stood for "the rule of law." Tom Fitton said it meant a lot to him that others were praying, that they all felt the prayers. They also feel the weight of Dred Scott. That is why, not trusting the Supreme Court, Judicial Watch is asking a local judge to be annoyed that he was lied to by a Department that claims the name Justice. Forty years ago, a daughter explained why her father defected from Communism: "He was immensely pro-Soviet and then--one night--in Moscow--he heard screams. That's all. Simply one night he heard screams." The screams her father heard were echoed in a Miami house the day before Easter. The screams are a reminder of the passage of the most brutal of all centuries in which tens of millions died fighting for and fighting against the idea that man should serve the state. Did America learn anything from that century? We shall see today.
