Subject: 9th Circuit Opinion re Favish vs OIC (Foster Photos) Out Today
Allan called me minutes ago and asked that I post about the
release in his appeal to the US 9th Circuit Court of Appeals in
his case against the Starr OIC to get various photos of Foster
released under FOIA.
NOTE: Someone, please post this to the Free Republic site, Allan
requested since I'm not sure how to do so.
[Although Allan didn't mention this, anyone following the
"Foster" thread(s) on Courtroom might want to post this
information there as well.]
Apparently the 9th Circuit Court of Appeals remanded (send back)
the case to the Federal District Court with instructions that the
District Court Judge view the photos in question "in camera"
(judge alone) to determine which (if any) should be released
under FOIA.
Neither Allan nor I have read the full opinion of the 9th Circuit
yet so we are not sure how "good" it is from Allan's persepctive,
but at least the 9th Circuit did not agree fully with the
District court's opinion.

Once at that site, click on "opinions" and then click on "Favish
versus OIC" (the opinion came down today from what Allan told
me).
