Experts from Ontrack Data International of Minneapolis, which recovers computerized data for law enforcement agencies here and abroad, said a court-ordered test they conducted last Friday might have gone even more swiftly if the computer test tapes they were given had not been set at surprisingly slow copying speeds. The missing e-mails are contained on backup tapes that must be copied and put into a searchable format. Michael Norby, the Ontrack specialist who copied the tapes, said he believed the settings had been "intentionally altered" and doubted they were representative of the thousands of White House backup tapes containing the missing e-mail. White House officials had said prior to yesterday's hearing before U.S. District Judge Royce C. Lamberth that it was taking their experts about 50 hours to copy each of the voluminous backup tapes. They described the effort as complicated work that made it impossible for them to comply with the promises of White House lawyers to submit all subpoenaed messages on the tapes to investigating agencies by late September. The office of independent counsel Robert W. Ray, House and Senate committees and civil litigants have sought the e-mails in a variety of probes, from the dismissal of White House travel office employees to the Monica Lewinsky scandal. Norby said he made a copy of the test tape last week in two hours and nine minutes. When Justice Department lawyers representing the White House described the test as incomplete, Norby made another, complete copy at the courthouse in an hour and 51 minutes. A government witness, Craig Ekberg, whose company has been monitoring the slow-moving White House duplication work, denied that the test tapes had been doctored and indicated that copying speeds vary depending on the age of each tape. Using Ontrack's method, he said, the company doing the work for the White House, SRA International Inc. of Fairfax, is now able to make a copy in four hours and 50 minutes. Yesterday's hearing stemmed from a lawsuit filed by Judicial Watch, a conservative group, on behalf of Reagan and Bush administration employees whose FBI files were improperly obtained by the Clinton White House in 1993-94. Judicial Watch chairman Larry Klayman derided the sudden improvement in White House duplication and said it underscored a continuing pattern of "obfuscation, misstatements and at times out-and-out lies" that have hobbled the lawsuit since it was filed in 1996. He urged the court to put Ontrack in charge of the copying effort.
