By Scott McMahan Bowman, Esq., Defense Counsel for Daniel E. Petersen. (Hey Carnivore, put this in your pipe, and choke on it). I just want to note up front that I apologize for the delay in the release of this information. This ("Freemen" Standoff/Trial) episode "blew" my mind, forced me to the verge of bankruptcy, cost me my sanity (AKA - "Loco"), practically lost me my family, and was as much a multidimensional, spiritual battle as anything else - buy me a couple beers, and I'll tell you the rest of the story. In any event, I returned to Montana in 1998 for the trial because of contacts made while involved in the "Freemen" standoff in 1996. While at trial, I was the only one of twelve defense lawyers who was not paid by the Govt., or anyone else for that matter, to be there. I could have accepted court-appointed-counsel fees, but out of respect to my client (and a naive belief that it mattered to my client), there was no "feeding" from the public trough. First off though, what every American Citizen should know, is that the reason the "Freemen" standoff ended peacefully, was because militia groups across this Country (tens, if not hundreds, of thousands) promised a war against the Govt. should any "Freemen" die at the hands of the Multi-Jurisdictional Task Force. I should know, I was there. If you're interested, I did write a book about it called the "Turning Point." Furthermore, the Militia refrained from provoking "THE" war on account of the idea that a trial would bring the truth to light (and, as a consequence why there will most likely never be a peaceful end to another one of "these" standoffs). Although the "Freemen" (at least, the real ones) sought only to expose the fraud of the Federal Reserve, the fraud of the "Corporate USA", and other frauds of Govt., etc., and stated that all they especially wanted was to bring their "evidence" to court, they specifically insisted upon a "Common Law Court" under Montana Law - which, was not what they got. (Legal opinion: the law required it, it was the last chance to salvage Our Republic, the feds knew it/played it, and was the last-best chance to beat them at the lawful "game"). What the "Freemen" did get was: a negotiated surrender that was abrogated by the feds, a kangaroo court, torture in prison, and convictions based more upon duress imposed upon the jury than upon actual crimes committed. You have to remember that as of this date (8/4/2000), the validity of the "Freemen" liens, which were the basis for the Certified Money Orders (the root of all their alleged RICO crimes) has NEVER been adjudicated. The real "Freemen" still incarcerated are simply political prisoners. Interesting to note, is that just after the miserable failure of the feds to get a good case out of the trial of accessories (actually/strangely, held before the trial of the alleged perpetrators), Garfield County Prosecuting Attorney, Nicholas Murnion, was given the J. F. Kennedy Foundation's Law Enforcement Officer of the Year recognition and award ($25,000) by the Foundation's director (Leibenthal or Rosenburg something). It should also be noted that to try the accessories before the "alleged" perpetrators is, at the least, ludicrous. And, also interesting to note, is that on January, 1998, (a couple months before the trials) the Garfield County Courthouse, the place where the "Freemen" had filed many of their liens and other documents, mysteriously burned to the ground. What really came out at trial was: 1) This (standoff) was, in my opinion, a setup by the feds (Blood Game for gun control - like Waco, Ruby Ridge, etc.); 2) The feds had, in my opinion, placed infiltrators" in the position of "Freemen"; 3) The feds had placed infiltrators" in the position of well-known and nationally recognized "militia" leaders in order to steer the true militia away from the standoff (Trochmann and Olson tried to "blow" us off); 4) The "Freemen" (namely Leroy Schweitzer), had issued CMOs nationwide, throughout the so-called "common law" movement (the next agendadized "domestic terrorists"); 5) These CMOs were, up to a point, accepted by the Federal Reserve, Internal Revenue Service and the Treasury Department as "legal tender"; 6) The Montana Public Defenders (10 of the 11 other defense attorneys were clueless of the "CONSPIRACY", although Skurdall's and Jacobi's attorneys were topnotch gentlemen out of Helena, Montana); 7) CMOs in Ohio were essentially the reason why common law/One Supreme Court justice/Militia Chaplain, Michael Hill, died from police gunfire in a traffic stop in Frazeysburg, Ohio in late summer 1995; and, 8) There was no justice at trial - although the jury gave it her best shot. The prosecution's case was simply an appeal to negative labels (like Jacobi the "firmament-theory" religious-kook, and Schweitzer, the "Hitler" of the bunch) and assertions of illegal activity with no proof of underlying criminal intent, nor anything more than an assertion that the liens were invalid. (All of which was brought to the jury's attention with little ultimate avail - no one beats the king in the king's court). >From witness testimony at trial what I learned was: 1) The press (ABC and NBC) worked to label the Freemen as religious fanatics, based mainly on the rantings of one alleged "Freemen" (Dale Jacobi). Jacobi happened to be an illegal alien, supposedly a retired cop from Canada, who, although arrested in Roundup, Montana and transported to the Yellowstone County Detention facility in Billings, Montana, was released by the feds to return to Skurdall's cabin. The feds and the local Sheriff belied their repeated claims that they were afraid to go in before the standoff and arrest these guys (Skurdall, Petersen, Jacobi and Schweitzer) at Skurdall's cabin near Roundup because they were so dangerous. In other words, the feds and the local Sheriff both had "failed" to do a background check on Jacobi, and let him return to join the "Freemen." What you should know about the "Freemen" - the real ones - is that they were salt-of-the-earth ranchers with incredible legal knowledge who had the law of the Montana territory backing their claims, who wouldn't hurt a fly, and whose ranches sat atop the largest oil reserve in the world (known as - the "Williston Basin"); 2) Alison (sounds like) Saysnon (SP?), the NY "News" reporter who testified that she peed her pants when approached by armed "Freemen" - who made a Citizens' arrest of her and her camera crew as they trespassed onto the "Freemen" ranch of Ralph Clark - "Freudian slipped" under questioning while on the stand when asked if she got a good look at those ("Freemen") who arrested her, saying, "I didn't get good look at the VICTIMS." (Note: this Bitch was a well-trained fake/commie!); 3) Ray Southwell, sidekick of alleged Michigan Militia leader, Norman Olson, was working for the feds; 4) Although the Federal Reserve note is a lien on the assets of the Federal Reserve (Private) Corporation and can be deposited, there was no reason given why the "Freemen's" liens could not be deposited as credits. Nor were the "Freemen's" liens ever adjudicated as being fraudulent. According to Fed Reserve representative (prosecution witness) Shockey, who actually denied the Fed Reserve note was in fact a lien, his lawyers, upon orders, simply "removed" the recorded liens from the record on their own accord; and, 5) Agnes Stanton was approached by feds on her property near where the standoff took place, and was allowed by the feds to leave her residence and join the "Freemen" right before the standoff began; and; 6) I'm sure there is more, and it may come out in a book, but take my word for it, this trial was a sham, brut force dictated the outcome for/by the feds, and, they were embarrassed because they were BLOWN AWAY by someone who knew what the deal was (apologetically (NOT), me). Also, of importance, was that (seemingly to me/and others anyway) the "Freemen's" public relations center, known as the Freedom Center, in Billings, Montana "funded" by Rudy Stanko, (served time in fed prison/mind control?) and run by Randy Parsons, was no more than a damage control operation run by the commie/feds. If you called in, you're on the list. I do remember getting "drugged" there when accepting an opened beer from the husband of a "plant" - I should have known better, but no body is perfect. (I cannot account for about 4 hours - scary!!!). It has taken me a long time to come to grips with all that transpired, and believe me, I was already "blown away" by what I found out during the standoff (not a plug-but, you should read my book about same). I write this now because I feel time is short, and I do not want the good Lord to tell me I came up lacking - Praise Him, He has given me so much! I am in essence, an ignorant sinner, have been exposed to more than I can handle, yet pray for a Republic that will guarantee FREEDOM to my children and grandchildren, AMEN. So, for what it is worth, there it is. I hope it helps you know what to do when the time comes-prayerfully, never. Another few facts you might like to know are, the feds on the stand at the first trial of "core" defendants in the "Freemen" trial of 1998, kept testifying about how all they were really concerned about was the safety of the "Freemen" under siege at the ranches; however: 1) It came out in testimony that the feds were tapping the "Freemen's" phones, knew the Landers crew was heading in from the Carolinas with a motor home and a suburban truck they had "illegally" purchased with CMOs (i.e. - fugitives from justice), yet, the feds let them drive clear across the Country and join the "Freemen" a few days before the siege was initiated. Russ Landers was heard on tape recordings of the "Freemen" during the standoff as being one angry bastard ready to "shoot it up their asses" (LOL). This really turned the jury against him. And Dana Dudely Landers was mysteriously "pleaded out" of the trial of core defendants by a couple of lawyers out of Louisville, Kentucky. It was funny how a Ms. Bowman, age, approximately 40 years (unknown to me, but obviously a fed in a poorly put together disguise of a "pigtailed" teenie-booper) had somehow, according to the "Freedom Center," come up with $100,000 for Dana's defense. This donor-fed, initially tried to talk my ear off while the judge was introducing me into the case; 2) The Hances, also out of the Carolinas were also fugitives from justice, also called ahead to let the "Freemen" know they were coming, and also could have been easily picked up anywhere across the Country as they drove to Justus Township just prior to the crackdown. Mysteriously, the feds just let them waltz right in to the ranch. This is especially incredible, because if you have ever driven to Jordan, Monatan, there are only two ways in, down long stretches of black top with few if any paved turnoffs. In other words, it would have been damned easy to pick these folks off; 3) The Wards, out of Michigan, were also directed by most likely feds, to get to Justus Township, just prior to the crackdown; and, 4) Do not forget that the two alleged "Freemen" (Schweitzer and Petersen) were pulled off the ranch the day of the crackdown. Schweitzer lead "his" crew into avoiding the trial (although he adamantly said he wanted to present his evidence to a jury - (given, he wanted a common law jury, didn't want to accept the jurisdiction of the court (LOL) BUT HAD TESTIFIED in many other cases involving "Freemen" CMOs). Schweitzer would not let me interview him at all. Petersen agreed to testify, which was my whole case (I entered two months before the trial began - the case was two years old by then), and then, at the last minute, decided not to take the witness stand. The fact of the matter, in my not so humble opinion, is that this whole standoff was an orchestrated event designed to result in the slaughter of the real "Freemen," which would lead to promotion of the Anti-domestic terrorism legislation, and would label all in the common law movement, especially Christian Identity folks, as the terrorists needing to be thrown to the lions. If it had not been for the many Patriots across this Country who stood and declared on April 2, 1996, that the death of one "Freemen" would mean civil war, causing the feds to bring in negotiators on 4/4/96, and artfully back peddle thereafter, I probably wouldn't be here to tell you about all this.
