However when the police removed the lock-downed activists and attempted to take them to a police vehicle dozens of supporters outside blockaded the vehicle created a confusing scene which resulted in the "un-arresting" of the 3 activists. Phone lines into Cubara (the town nearest the Gibraltar 1 well site) are down but reports are that the militarization continues. There has been no eviction yet but we have received reports that government planes are repeatedly flying over the U'wa encampment and shooting into the nearby woods. However the U'wa refused to be intimidated and have vowed to block any further equipment that Oxy attempts to bring to the drillsite. On September 15th, the U'wa went public with very important legal documents showing that the King of Spain granted them legal title to the entire area around the drillsite as well as the sub-surface rights. (SEE #3 BELOW) These colonial lands claims have standing in Colombian courts and have been a factor in several land disputes over the past decade. Mr. Gore has deep personal and financial ties to Occidental, including family investments of up to $1 million in the company. The group of local U wa supporters report that the electricity in the Democratic National Committee headquarters they are occupying has been turned off. Meanwhile in Des Moines, Iowa today seven activists blockaded Gore s campaign headquarters, locking down to an oil barrel, while joined by some 75 other protestors, all demanding the vice president take immediate action on the U wa situation. On Sunday, 150 people demonstrated at Gore s campaign office in Portland, Oregon, with four people arrested in protest of Gore s silence on the U wa crisis. This most recent wave of protests aimed at Al Gore comes in response to the escalating tension on the ground in Colombia. In recent weeks, U wa leaders have reported that the Colombian military has planted land mines on U wa territory to protect Occidental s planned drilling project. This legal development fundamentally challenges the legality of Occidental Petroleum's project on U'wa land. According to U wa legal representative Ebaristo Tegria, the area which the U wa claim as their traditional homeland, including the Oxy well-site, is in fact titled to the U wa under a 1661 ruling by the King of Spain. The "Royal Land Deed" issued by the King recognizes the pre-existing rights of indigenous people in Colombia, including their sub-surface land rights. In 1873, the Colombian government claimed all sub-surface mineral rights as property of the nation except those previously ceded by the historic "Royal Land Deed" law. This legal precedent has significant implications for the U wa s current struggle with Oxy. In the past, both the Colombian Council of State and Supreme Court have repeatedly upheld the colonial law. Even Occidental itself, according to Mr. Tegria, has previously recognized and honored the law. This groundbreaking news comes on the heels of growing concern about human rights violations on U wa legal and ancestral territory. Roberto Perez, the President of the U wa Tribal Council has voiced his fear that the military may carry out a violent removal of his people from the well site area in the coming days. Earlier this week, the Colombian Agrarian Reform Institute declared the 500 meter area surrounding Oxy s well-site a "petroleum reserve zone." The military in the region has repeatedly denied access to the U wa even though the community holds legal title to two farms embracing the wellsite.
