-Caveat Lector- http://www.msnbc.com/news/474067.asp Subpoenas sent to Bush media firm Investigation into diversion of debate materials intensifies MSNBC WASHINGTON, Oct. 8 � A federal grand jury has subpoenaed records from George W. Bush�s ad firm, Maverick Media, as investigators seek to identify the source of confidential debate preparation materials for Bush that were mailed to an adviser to Al Gore, a Bush campaign aide said Sunday. The investigation remains focused on Juanita Yvette Lozano, a 30-year-old staff member of Bush�s ad agency. CONFIRMING THE MAIN points of a Newsweek report published earlier in the day, Bush aide Ari Fleischer told NBC News that the grand jury had sought unspecified documents from Maverick Media as well as information from the Republican candidate�s campaign, including: A written estimate of the value of the tape and briefing books sent to Gore adviser Tom Downey. Contracts and confidentiality agreements between the Bush campaign and Maverick. Material from the Bush campaign�s employee manual explaining how confidential information is supposed to be treated. Senior law enforcement officials told NBC News that records from the Gap clothing chain also had been subpoenaed in an attempt to verify the alibis of a Maverick employee who has emerged as the focus of the investigation. Gap officials insisted on the subpoena because the company didn�t want to voluntarily reveal customer information, the sources said. These sources, who spoke on condition of anonymity, also said that contrary to the Newsweek report, no conclusion has been reached about whether the diversion of the debate materials � a briefing book and a videotape detailing Bush�s preparation for his first debate with Gore � constituted a federal crime. Several statutes that could apply to the case remain under consideration, but until the FBI can determine who was responsible for mailing the documents to Downey there is no way to conclude which law might fit, the sources said. Maverick is run by Mark McKinnon, a lifelong Democrat who climbed aboard the Bush bandwagon in 1998 and helped the Republican capture the governor�s house in Texas. He has been told by the FBI that he�s not a target of the investigation, Newsweek reported. The magazine said the investigation remains focused on McKinnon�s assistant, Juanita Yvette Lozano. Lozano, a 30-year-old Democrat and longtime friend of McKinnon, was captured by a post office surveillance camera mailing a package Sept. 11. The time of her visit closely corresponds to the postmark on the package received by Downey that was mailed from that post office. Newsweek quoted an unidentified official as saying the surveillance tape is �pretty compelling� evidence. Lozano�s lawyer, Chris Gunter, told Newsweek that his client mailed a package she �thought� contained pants that McKinnon wanted returned to the Gap. Gunter was quoted as saying his client �did nothing wrong.� For his part, McKinnon, who has previously confirmed Lozano�s account that she was returning a pair of pants, has hired Texas trial lawyer Rusty Hardin. He told Newsweek that he will fully cooperate with the investigation. The magazine reported that McKinnon last week had decided to place Lozano on paid leave but reversed his course after top Bush aides expressed concerns about the �perception� it would leave.
