As you read the following, keep in mind that two and a half hours before the hearing I telephoned the Los Angeles office of the Associated Press to tell them about the hearing. Soon after I began my description of the event I stated that the subject matter was photographs of Vincent Foster's deceased body. As soon as I said Foster's name, the AP person interrupted me and said, "Thank you very much," and then she immediately hung up the phone. What occurred at the hearing will be a surprise to most people. Those with any interest in this case will want to read two documents in their entirety: 1) the transcript of the hearing, and 2) the draft motion I gave to the OIC's attorney. You need to read both to fully understand what is happening. To read them, go to my web site (address below) and go to the Foster section. OIC" You will find two additions to the table of documents dated October 13, 2000. There is much more to these documents than what I've put in these brief descriptions. The first one says: "The transcript of the hearing at which the OIC's attorney said that the OIC did not want to show the district court judge the original photos, but instead wanted to show him copies. The judge rejected that position and ordered the originals tobe produced to him.The OIC's attorney also said that the OIC did not want to release the original of the"gun-in-hand" photo. This wasdespite the fact that the OIC's only basis for arguing that the photo be withheld was that it was"graphic, explicit, and extremely upsetting," and the Ninth Circuit ruled that the OIC's description was "nottrue". At this hearing I also told the judge I intended to file a motion to compel testimony as described below." The second one says: "The draft motion (Adobe Acrobat PDF 25KB) given to theOIC's attorney that will be filed to insure that any photos produced bythe OIC are the pristine originals. The draft motion asks thecourt tocompel the testimony of former OIC prosecutor Miquel Rodriguez andhis former OIC assistant Lucia Rambusch regarding allegations of illegal conduct byOIC andFBI personnel as toone or more of the photos at issue in this case.The draft was given as part of a local court requirement that the parties disclose any proposed motions and try to resolve the matter informally before making a motion.
