TALLAHASSEE -A trial date has been set for an unheralded court
case that could swing nearly 5,000 votes - and the election - Al
Gore's way.

Leon County Circuit Court Judge Nikki Clark yesterday set Dec.
6 for an expected one-day trial in a case brought by Democratic
voter Harry Jacobs against Seminole County and the Bush campaign.

The suit charges the Republican election supervisor in the
central Florida county "corrupted the integrity of the electoral
process" by letting GOP members "alter" about 4,700 applications
for absentee ballots.

The forms had initially been rejected because they lacked the
required voter-ID numbers.

Election supervisor Sandra Goard admits she allowed Republicans
use of her office and access to records to fill in the missing
information.

The suit claims Democrats were not offered similar options.

"Illegal votes cast by absentee ballot in Seminole County are
sufficient to change the outcome of the election in the state of
Florida for president of the United States, or, at a minimum,
place the result in serious doubt," the suit says.

Because it would be nearly impossible to determine which ballots
corresponded with the so-called altered applications, the suit
seeks to have all 15,000 absentee ballots in the county thrown
out.

George W.  Bush secured 10,006 absentee votes to Gore's 5,209 in
Seminole County.

The Texas governor on Sunday was certified the winner of the
state's 25 electoral votes by a 537-vote margin.

It would be impossible to make up a 4,800-vote gap, his aides
concede.

"It would sink us," said one campaign aide.

Bush lawyer Barry Richard said anyone is entitled under Florida
law to help a voter fill out an absentee ballot application.

"No one alleges improprieties with the ballots," Richard said.
"There's really no issue here about anyone doing anything that
was illegal or suspect.  It has nothing to do with the ballots."

The Gore campaign has been quick to distance itself from the
lawsuit, recognizing the difficulty of supporting it publicly
while at the same time arguing in its legal filings that every
vote should be counted.

The case, originally filed in Seminole County, was transferred to
Tallahassee this week at the request of the Bush campaign.
