What is really needed is an end to Drug Testing.  Nationally over 75% of
employers use Drug Testing in screening applicants and there after use
Random Testing to insure compliance.  What isn't as obvious is that most
of these same companies only test blue collar workers leaving management
and executive untested. The recent push to Drug Test public school
children is laughable because, like all government employees, the only
employees at public school that can be tested are Buss Drivers.  With the
exception of Police, Fire and CDL license holders, all government
(federal, state, county and municipal) employees are exempt from testing.
Some agencies do require that you "voluntarily submit" to testing, but it
is not a REQUIREMENT.  No person holding any elected office is tested.
Very few Unionized workers are tested.  These practices have been found
to be discrimminatory by Human RIghts Commissions because they target
only those who are least able to defend themselves.  The Supreme Court,
while ruling that Drug Testing is a search, have refused to hear all but
two (Skinner v Railway Labor Executives Association and National Treasury
Employees Union v Von Raab) cases dealing with this.  In the two cases
they did hear, it was blatantly obvious that a good case could be made
for drug testing these particular employees for safety/security reasons.


The other problem with drug testing lies in the length of time each drug
can be detected in the body using urinalysis.  Marijuana is detectable up
to 60 days after use because it is water soluable.  All the other drugs
become invisible after a week, and most within 3 days.  This makes the
most innocious of drugs the one that eliminates most people from
employment.  The Journal Of American Toxicology, vol 21, July/August 1997
shows that you can test positive for marijuana after ingesting many
health foods.

I am in favor of drug testing if there is an accident and the test can
show that the person was under the influence at the time of the accident.
 However, the fact that at some time in the past you smoked a joint
should have no weight in ANY present circumstance.

Do I favor drug laws?  Yes, the same drug laws that cover all other
drugs.  Naturally occuring substances, with no chemical additives, should
be legal just as all other herbs are available.  Any substance that is
manufactured should be tested for purity, labeled as to content, and
available to the adult population based on a harm analyisis (by the
medical community NOT the justice system) as to whether it should be over
the counter or by perscription.  No intoxicants should be used by minors.
  The question as to who is a minor is another arguement for another day,
but consider that at the age of 18 you can buy a rifle (or get issued it
by the military), vote, marry, incur debts, be sued, sign binding
contracts, etc, but you can not drink alcohol.  Does this seem rather
stupid?
