I just don't get this spin that the Florida SC keeps creating new law and
over-stepping their legal authority. Courts provide remedies for conflicts,
do they not?
Every time a court says John Doe is entitled to 500 grand for injuries done
in such and such a case, they didn't pull that remedy out of
101.something/section 4 that says, "If John Doe of E. 12th street gets hits
by a car, the courts shall award him 500 grand." Courts look at the law,
look at precedent, consider matters of justice and resolution and enact an
appropriate remedy. This is what courts DO.
Reasonable people can disagree on matters of legal philosophy - such as
with the differences between a constructionist vs. an activist bench, but
these are matters of philosophy.
