Re: Ethics Inquiry Involving Hillary Rodham Clinton: Supplemental
Information
Dear Chairman Roberts:
This letter is in furtherance of Landmark Legal Foundation�s
(Landmark) ethics inquiry of December 18, 2000.
In that letter, Landmark raised the likelihood that Senate Rule
37, involving conflicts of interest, may be violated by
Senator-elect Hillary Rodham Clinton�s $8 million book deal
inasmuch as Mrs. Clinton�s publisher � Simon & Schuster -- is a
subsidiary of Viacom, Inc. (Viacom).
Landmark has since learned that Viacom employs several lobbyists
to advance its interests in communications, copyrights, patents
and trademarks, including: Ann Delory, Kimber Fritts, Matthew
Gelman, Charles Hansen, Claudia Jones, Andrew Littman and Anthony
Podesta. Clearly Viacom frequently has numerous interests before
Congress and federal agencies.
Anthony Podesta, a Viacom lobbyist, is the brother of John
Podesta, Chief of Staff to President Bill Clinton. The fact that
Mrs. Clinton�s $8 million book advance from a Viacom subsidiary
is far in excess of publishing industry norms, and that the
Clintons have a unique relationship with the Podestas, raises
questions about the special nature of this book deal under Senate
Rule 36.
Rule 36 provides that limits on outside earned income do not
include �copyright royalties or their functional equivalents from
the use or sale of copyright, patent, and similar forms of
intellectual property rights, when received from established
users or purchasers of those rights pursuant to usual and
customary contractual terms.�
This information underscores the need for the Senate Select
Committee on Ethics (Committee) to examine Mrs. Clinton�s book
deal. Moreover, Landmark repeats its request that the Committee
make public the means by which it will ensure that Mrs. Clinton
does not act on legislation that may benefit Viacom or any of its
business entities in violation of Rule 37.
