Once I saw the Secret Service clearing the streets of Columbus - it was my custom to bring hot coffee to this one mad, who would lay in the entry of a store long closed which had been popular until street people hit the streets - but what I noted at night was not so much the poor taking to the streets - but I shall never forget this vile lewd black man, dressed as a woman in maroon shiney material, walking up and down the streets - and being bombarded by young blacks, well dressed demanding money and this was only 6 in the evening - prostitutes walking streets in a once great "cow town" they called it on Johnny Carson because at that time we just didn't have queers and a cess pool of night life coming out of water closets. The man to whom I brought coffe, looked like a Charlie Manson - a wino, and wrapped in American Flag - maybe even an old time hippie longing for the past.....but this man was roushed up a bit and shuffled away without his coffee that am, for you see Clinton was coming to town - this would have been in 1994 or 1993......many were given COTA passes to ride the bus all day but oh, dare not let the world see what has happened to Columbus - they should see it today...... Today we have in Columbus, a black mayor and a black chief of police who previously had been up on many different charges including being on streets in areas where his conduct was questioned.....attempts by the Mayor to rid the deprtment of this man failed - our NAACP saw to that.........now when the new King Center was built with auditorium/theatre and stores, blacks demanded whites come to their stores and patronize them......they got to be kidding - first of all, take that up with the Lazaras family....(and that store is going busto - guess Lazaras already bailed out)...... So where are they going to hide all these people now.....what I did years ago was to look into the Slum Landlords - renting condemned properties - interesting to see who owns these properties and for what you pay in rent in one of those dumps, say like an Al Gore slum property, you could find a nice apartment. So the poor we have with us always.....and the morning after pills seem to be devised to prevent birth of babies of more affluent individuals.....so now they cannot even give this stuff away....but we have the Jesse Jacksons and this asshole out in San Francisco, another black God Shouter who backed up Jesse with I have an illegitimate kid on the way too. Imagine what the cities will be like in say another ten years......what lovely people as the suburbs arm up.....years ago more affluent whites including all your major TV stars, etc (who now carry guns by special decree, some of them, yet push to take this right from the Amerian people)......but imagine cities in 10 years and then ask yourself - why such expensive pills and backed by Planned Parenthood? Have better solution for Canada and England and America - confiscate the slum landlord property - for a lot of this property is bought up by Judges in Probate Courts and lawyers....give the property to these street people who have no desire to work, evidently their only desire is to die - and make their lives as comfortable as possible.....many would be entitled to Social Security? Saba A Nation of Sheep: The Legal Response to Homelessness December 24, 1993 Homeless in the United States is not only misunderstood by most Americans, but a majority of those working on the problem address symptoms, not causes. This lack of understanding and the failure to address underlying causes is the principle reason that it persists and grows. Until we come to grips with our failure and our ignorance, there will be no solutions, only insincere rhetoric of concern, misguided notions of achievement and a false sense of dedication to the principles upon which this nation was founded. We have become spiritually shallow, morally bankrupt, and unworthy of any claim to world leadership. No citizen dedicated to the principles which we espouse ought feel anything but shame and disgust for following callous leaders as mindless sheep follow blind shepherds into a pit of darkness. Harsh words? Absolutely! Unjustified? Hardly! One has only to look at the trends in legal harassment and inhumane treatment of our homeless to realize that, rather than being too critical, the opening statement falls far short of what should be said to anyone who has even a modicum of awareness of how the poorest of the poor are treated in this country and chooses to remain silent. There are no moral leaders with a voice strong enough to be heard above the clamor of pompous jackals. There are no political leaders with the convictions of spiritual values able to sway an uncaring public into honestly facing festering problems whose consequences hold decent folk in fear for their lives and their property. Rather, there are only sheep, unable and unwilling to stand up for truth and decency in how we treat our poor. Sadly, there is an abundance of those who prey on fear and ignorance to gain power for themselves and their politics by promoting insensitive and cruel treatment of the poor in a country that values materialism and personal gain above all else. The National Law Center on Homelessness & Poverty released a report in December 1993, The Right To Remain Nowhere, based on the anti-homeless laws and litigation in 16 US cities. There are many named, either individually or as part of a group, who deserve to be publicly chastised for the barbaric policies which they promote and the senseless punishment that they inflict on helpless citizens blamed more for personal failings than that they are victims of poverty left unchecked. Rather than rank and judge them for the severity of their immoral actions, they are identified in the order in which they are presented in the report. Cities In Moral Decay Atlanta, Georgia: Mayor Maynard H. Jackson; members of the City Council; members of the Central Atlanta Progress, a business group; Atlanta Police Department. Much of their cruelty stems from an attempt to "clean up" the city in preparation for the 1996 summer Olympic Games. Oakland, California: California Department of Transportation (Caltrans); Police Department. Among other things, bedrolls, medicine, food stamps and glasses were confiscated and thrown away for camping on property owned by Caltrans. San Francisco, California: former Mayor Agnos; Mayor Frank Jordan; County Board of Supervisors; San Francisco Police Department. In 1991, a police decoy sting operation wasted 450 hours of police time valued at about $11,000 to arrest 15 "aggressive panhandlers" that were never convicted of any crime. The Sergeant who conducted the sting said: "the overwhelming number of panhandlers . . . ask for money, then when refused, say 'thank you, have a nice day' or 'God Bless you.'" More recently, they have enacted harsher laws of intimidation, jailings and fines. Southern California Municipalities: West Hollywood; Long Beach; Santa Monica; Orange; Fullerton; Santa Ana; Beverly Hills; Los Angeles; Anaheim; Santa Barbara. In 1990, Santa Ana police arrested 64 homeless men and women in the civic center, drove them to a stadium for booking, chained them to benches for six hours without food or water and wrote identification numbers on their arms. Los Angeles Mayor Richard Riordan deserves attention for his call to void any and all aid to those whom he feels are beyond salvation. Chicago, Illinois: City Alderman; Chicago Police; local politicians; Chicago Dept. of Aviation (O'Hare Airport); Fire Department paramedics. The latter deserve critical mention for leaving a homeless man, thought dead, on the streets for two hours, after which the man was taken to a hospital where doctors encountered vital signs yet were unable to revive him. The police on the scene deserve mention for determining that he died of natural causes even though "his nose was broken, there were bruises on his face, his pockets were turned inside out and one of his shoes was found a number of feet from his body." A substantial increase in the number of visible homeless is the result of cuts in General Assistance benefits to more than 100,000 recipients by the state of Illinois, 80,000 of whom live in the Chicago area. Cincinnati, Ohio: City Officials; Police Department; US District Court for the Southern District of Ohio. The court dismissed a complaint against a panhandling ordinance on the basis that the plaintiffs failed to show that they had "suffered a past or future injury sufficient to confer standing." Dallas, Texas: City Council; Police Department; Dallas business community. The city plans to enforce an ordinance which prohibits sleeping in public, and to move homeless people to less visible area's of the city. One council member suggested that the homeless who fail to relocate from downtown areas and under highway overpasses be given bus tickets out of the city. Florida cities of Jacksonville, Key West, Miami, Orlando: City officials and Police Departments. The Orange Bowl in Miami has been the justification for increased harassment of the homeless along parade routes for many years. State of Nevada and cities of Las Vegas and Reno: City officials; Police Department; Las Vegas-Clark County Library Board of Trustees. On May 9, 1992, police arrested a homeless epileptic and either destroyed or misplaced his medication, leaving him in the police cruiser alone for over two hours, where he suffered a severe epileptic seizure. He was kept in jail for 21 days without his medication, suffering a seizure so severe that paramedics were called to jail to treat him. Charges were dismissed. New York City, New York: Transit Authority; Transit Police; Parks and Recreation Department. New York City Mayor Rudolph Giuliani deserves special mention for his pledge to turn the homeless out of shelters after 90 days, countering one advocates claim that more homeless people will be on the street as a result, saying "because most of these people belong in jail, and that's where they'll be." Seattle, Washington: City politicians and business leaders; City Council; Seattle Police Department; Parks Department; Supreme Court of Washington State. As of November 7, 1993, it will be a criminal offense for any person sitting or lying in any public street or sidewalk in downtown or neighborhood business districts from 7:00 AM to 9:00 PM. Washington, D.C.: Mayor Sharon Pratt Kelly; City Council; D.C. Police Department; Washington Metropolitan Transit Authority; National Park Police; US Marshalls. On June 5th, 1992, DC police came to a homeless camp and told them to eat all the food they had in five minutes, or it would be taken from them. Bobby Beamer, one of the homeless, claimed on policeman took his glasses and stomped them. Belongings were put in a garbage by sanitation workers, as in a similar incident October 6. Hostile Government Action The list of indignities inflicted on the homeless includes tickets, fines and jail for sleeping and camping on public property (where else will they sleep?), urinating in public (where are public facilities?), confiscating and/or destroying identification, removing park benches from public parks, anti panhandling laws (what jobs are available to an increasing number of America's poor?), breaking park curfews (even though "decent" citizens may do so at the same time as the homeless are arrested), zoning code changes to restrict construction of shelters and a myriad of other acts designed to remove the homeless from sight. Courts and the Constitution Many of the laws, ordinances and actions have been declared unconstitutional, or have resulted in awards to victims of harassment. The Second Circuit Court of Appeals upheld a lower court's ruling that a New York State law that banned all begging on public streets was over-broad and unconstitutional. Similarly, a federal district court judge ruled a California statute overly vague, and therefor unconstitutional. In a similar California ruling, the court stated that "no distinction of constitutional dimensions exists" between begging by a homeless person and solicitation by a charity. San Francisco police officers still use the law as a tool of harassment. A Miami court ruled against the city and police department for arresting homeless people for sleeping, eating and lying down in public, finding that the city had effectively made it illegal simply to be homeless, violating the right to travel, the right to be free from cruel and unusual punishment, the right to due process and the right to equal protection of the law. This prompted favorable actions in Las Vegas and Reno, Nevada, Key West, Florida, and Huntsville, Alabama. Warrantless search of a shelter was struck down in Washington, DC. The right of homeless persons to challenge seizure and destruction of property was upheld in California, resulting in the Oakland Police Department being ordered to pay $18,000 to seven plaintiffs who's property was destroyed. Numerous other challenges to anti-homeless laws and ordinances have succeeded in striking them down, or making them less severe, but the trend is unmistakable: cold hearts continue to do cruel things to helpless people. Saints Among Sinners While many homeless advocacy groups were cited in the struggle against anti-homeless legislation, Santa Monica City Attorney Robert M. Myers stands head and shoulders above most. When asked to draft an anti-camping ordinance aimed at the cities homeless, he refused, saying that any ordinance would be unconstitutional. Eventually, he drafted one based on a Santa Barbara ordinance which had been successfully enforced, but refused to prosecute people under it. He felt it would be improper to punish them for simply being homeless and being in public when the city did not have adequate shelter for the estimated 2,000 homeless. He was fired for this. God Bless You, sir. A court injunction was later issued forbidding the city to enforce the ordinance. Would that more had the courage of Mr. Myers, but sheep prefer the security of the flock, as in San Francisco: some members of the board of supervisors were alarmed by Mayor Jordan's atrocities against the homeless, but lacked the fortitude to oppose him even though their timid hearts felt otherwise. May they rest in peace - somewhere safe from the growing multitude of destitute souls that man has forsaken. David R.
