SMITH in New York Daily News Staff Writers With prosecutors set to call aides to both Bill and Hillary Rodham Clinton in a criminal investigation of clemency, the senator began referring questions about the probe yesterday to her personal lawyer. Former White House chief of staff John Podesta was set to meet with federal prosecutors today in New York, said one source familiar with the probe by Manhattan U.S. Attorney Mary Jo White. And two sources said some campaign aides to Sen. Hillary Rodham Clinton has been notified they will be questioned soon in the clemency-for-votes probe of the New Square Hasidic group, sources said. Yesterday, aides to Assembly Speaker Sheldon Silver � who attended a New Square meeting with the former First Lady � also said he has been asked to answer questions by prosecutors. The senator � who could be called to answer questions by White at any time � declined to comment. But, for the first time, an aide referred questions about New Square to David Kendall � the lawyer who represented then-President Bill Clinton during the Monica Lewinsky scandal. Kendall said only, "No comment." A Clinton aide said he was representing the senator in a private capacity. White is investigating three cases of last-minute clemency granted by the former President: Reduced jail time granted to four New Square leaders convicted of fraud; A last-minute pardon awarded to Marc Rich, who fled to Switzerland to avoid charges of evading taxes and violating the Trading with the Enemy Act; Allegations that the ex-President's brother, Roger, got fees for his unsuccessful efforts to press for pardons. In the case of Podesta, it was not clear what prosecutors wanted to know. But as point man at the White House on several pardons, he could face many questions. He did not return calls seeking comment yesterday. Sources say prosecutors want to ask the senator's campaign aides about meetings between her and the New Square Hasidim. The FBI has zeroed in on whether she promised clemency in exchange for the Rockland County community's support on Election Day. The close-knit community voted for her 1,400-to-12. The senator has repeatedly insisted she was not involved in the clemency issue, although it was well known that New Square leaders were consumed with the issue during the campaign. Shortly after the investigation, the Clintons met privately in the White House with the New Square grand rabbi, who pressed for clemency. The senator says she did not participate in that part of the conversation.
