Stan Lee Media Announces SEC Probe, Says Firm Found Possible Irregularities (Jan. 3) The U.S. Attorney's Office for the Eastern District of New York is seeking the extradition of Peter Paul, who co-founded the Encino, Calif., company with Stan Lee in 1999, from Brazil, where he is believed to reside. Stephen M. Gordon, the company's executive vice president, Charles Kusche, a stock promoter, and Jeffrey Pittsburg, a Wall Street analyst, have all been arrested, charged with securities fraud and conspiracy to commit securities fraud, and released on bail. Stan Lee, the creator of Spider-Man and the Incredible Hulk, wasn't charged in the indictment. Assistant U.S. Attorney Ken Breen said the investigation is continuing. Nicholas DeFeis, an attorney for Mr. Pittsburg, said his client "stands by the integrity of his research and plans to fight the charges." Harland Braun, who represents Mr. Gordon, said his client carried out "basic mechanical functions of the company without any understanding whatsoever of the overall scheme." Mr. Kusche and Mr. Lee weren't available for comment. Larry Klayman, Mr. Paul's attorney and head of Judicial Watch, a conservative organization that has filed suits against the Clinton administration, said his client is cooperating with prosecutors. Unrelated to the charges, Mr. Klayman also said Mr. Paul was a contributor to the Senate campaign of Hillary Rodham Clinton and that he had discussed a "deal to induce Bill Clinton to work with his business ventures after he left the White House." A Center for Responsive Politics database shows that Stan Lee Media gave $100,000 in soft money to a group backing Mrs. Clinton's candidacy. A spokeswoman for Sen. Clinton (D., N.Y.) declined comment. A spokeswoman for Mr. Clinton didn't return phone calls. According to the indictment, Messrs. Paul and Gordon hired Mr. Pittsburg to tout Stan Lee stock. The government also alleges that Messrs. Paul and Gordon borrowed large sums from Merrill Lynch & Co. through nominee accounts using Stan Lee stock as collateral as a way to sell their Stan Lee stock without causing the share price to plummet. Then, to sell their secretly owned stock, Messrs. Paul and Gordon made undisclosed payments to Messrs. Pittsburg and Kusche, who arranged for others to buy the stock. According to the indictment, Messrs. Paul and Gordon stopped making payments to Messrs. Pittsburg and Kusche in late 2000. This caused Stan Lee's stock price to plunge, leaving investors with worthless stock and Merrill Lynch with no collateral of value.
