Ryan Senior Washington Correspondent WASHINGTON -- A former FBI lie detector expert testified Wednesday that Teamsters ex-President Ron Carey easily passed a polygraph test when asked if he ever took part in a "swap scheme" that illegally diverted union funds into his presidential campaign. "I did not find indication of deception," said Barry Colvert, who retired from the FBI a year ago after nearly 35 years. "And it really wasn't a close call." A short time later, Carey emphatically told a federal panel that he "absolutely" was unaware of the scheme in which the Teamsters union contributed money to organizations in exchange for their funneling money into Carey's campaign. The Independent Review Board, a three-member panel created by a 1989 agreement between the government and the Teamsters to monitor the union, is conducting three days of hearings to determine if Carey should be thrown out of the union he joined in 1955 and has led since 1992. Meanwhile, the New York U.S. Attorney conducting a criminal investigation of the tainted union election agreed to ask Jere Nash, Carey's chief accuser, to appear at the Review Board hearing. Nash, Carey's 1996 campaign manager, and Martin Davis, another top Carey aide, pleaded guilty to taking part in the illegal money-laundering scheme and are cooperating with the federal criminal investigation. Nash implicated Carey in the plot. But Nash cannot be compelled to testify before the Review Board and Frederick Lacey, a Review Board member who is acting as chairman, said he was "not optimistic" he would appear. Carey won a narrow victory over Detroit labor lawyer James P. Hoffa in the 1996 campaign. The election subsequently was overturned because of the illegal diversion of funds and Carey was barred from running again. He currently is on leave of absence as Teamsters president. But independent polygraph consultant Colvert told the board he tested Carey at the request of the labor leader's attorneys in late November. In a control test, Colvert said, it was easy to determine when Carey attempted to lie about a number he had picked between two and eight. The expert agreed he "nailed him" on the number test. But on the real test there was not the slightest indication that Carey was lying, Colvert said. Charles Carberry, the Review Board's chief investigator, suggested Carey may have been at ease during the test because he knew if he failed, the results would remain secret. Moreover, Carberry said, Carey has told and retold his story so many times to numerous investigating committees that he may be able to fool the machine. On the witness stand Wednesday, Carey retold his story once again. He said he fully agreed with the Teamsters union contributing $475,000 to Citizens Action; $175,000 to Project Vote and $85,000 to the National Council of Senior Citizens because they were all good grass-roots organizations that backed the same causes he did. But he vigorously denied approving the actual contributions or knowing that they were given only on the condition that the groups return a portion of the money to Carey's presidential campaign.
