Troy Michael Bowron, of Oyster Bay, is suing the Jannali Inn, its licensee, and Mr Lucock for past and future loss of earnings over injuries he received when he slipped on the floor at the inn. Mr Bowron, an upholsterer, was playing pool at the hotel when he fell and broke both bones in his left forearm, and received injuries to his elbow. He had 12 weeks off work. He claims the hotel did not supervise and maintain a safe place, including a cleaning system, and that it allowed Mr Lucock to remain on the premises when he was intoxicated. He claims it breached its duty of care by its "failure to remove (Mr Lucock) ... in the knowledge that he was inebriated and was clad with pork chops strapped to his feet". Mr Bowron is also suing Mr Lucock for becoming intoxicated in a public place, "strapping pork chops to his feet and walking across the tiled floor ... producing a trap", creating a danger and not warning Mr Bowron of the danger. Mr Lucock, who was 27 at the time of the 1997 incident, represented himself. Outside the court, he said it had been a "rowdy drinks night", and the pork chops had been won in a meat tray raffle. Frank Stevens, counsel for Mr Bowron, said there was much "joviality" at the inn that night, and a staff member had told Mr Lucock that it was not acceptable for him to have bare feet. "The long and short is that one of the parties strapped some pork chops on their feet, and started to move around the area where the pool table is located. "If you handle pork chops they readily become greasy, and it is our position the pork fat from the pork chops became strewn across the floor and made it inherently dangerous," he said. Mr Stevens indicated a much wider claim - including an allowance for domestic assistance - would be made. The amended claim prompted Judge Anthony Puckeridge to urge Mr Lucock to get further legal advice for what was a complex matter. "If I was in your position, the red light would be flashing" he said. Mr Lucock said he couldn't afford the legal blills. Judge Puckeridge decried that legal aid was generally not available for civil cases. The hearing will continue.
