County Faces Penalty for Policy on Boy Scouts Jim Burns, CNSNews.com Thursday, Jan. 31, 2002 The education law signed recently by President Bush contains a provision that could result in Montgomery County, Md., losing $40 million in federal education funding because of the way it has treated the local chapter of the Boy Scouts of America. A group calling itself Public Advocate of the United States notified authorities Wednesday in the Washington suburb that they could lose the federal money for charging the Boy Scouts for meeting space on school property. The Scouts had previously met on the same property for decades at no charge. However, according to Public Advocate, such action is now illegal under the "Boy Scouts of America Equal Access Act," part of the new education plan. The BSA remains controversial because of its opposition to homosexuality, and in spite of a U.S. Supreme Court ruling two years ago that said the Boy Scouts could ban homosexuals from serving as Scout leaders. Jesse Binnall, a spokesman for Public Advocate, said other governments would be put on notice as well. "There is going to be more. It does appear that this is the first one that we have been able to research within our area. We're not ready to release anything yet, but look for Los Angeles, Broward County, Florida and possibly some places up in Massachusetts," said Binnall. "With our resources," Binnall said, "we are kind of doing things one at a time. But there is going to be more. There are several districts that have the problem, and if they do not fix the problem that they created after the Supreme Court ruling, they are going to find themselves without federal funding." Public Advocate is giving Montgomery County until Feb. 14 to change its policy with regard to the Boy Scouts before the group reports its findings to the U.S. Office of Civil Rights. The group contends that if the civil rights office finds that the county is in violation of the law, the secretary of education must withhold all federal education funding. "It is time that Montgomery County officials put the interest of their children above the special interest of the extreme homosexual lobby," stated Eugene Delgaudio, executive director of Public Advocate. "We ask that the county give the Boy Scouts of America a Valentine's Day present by rescinding these burdens that they have imposed against them." The Interagency Coordinating Board for the Use of Public Facilities is an independent agency that administers activities on school property for the Montgomery County government. The board insists the Boy Scouts are being treated fairly. "Why should any one group be treated differently from all of our other non-profit organizations? They, along with the other worthy organizations, should be paying the same non-profit rate. We are talking about three dollars an hour," said Ginny Gong, director of the Interagency Coordinating Board. "The decision was not just for Boy Scouts, it was for all scouting groups. We are talking about 4-H, Girl Scouts, and all of these groups are impacted. It is the interest of this board to make sure that we are not discriminating against any group. "Therefore," Gong said, "in the interest of equity and fair treatment of all non-profit organizations, and we have a lot of non-profits using our facilities, the board made the decision to charge the Scouts, like all the other groups, a reduced non-profit rate.
