Who's to decide, Mr. Simpson? The UN can decide, if just one First Nation
should hammer out a constitution for itself and start the proceedings
toward a seat in the UN General Assembly. Of course, it can always
negotiate a MERGER with BC and Canada after that. And it would do so on
equal terms, sovereign nation to sovereign nation.
Premier Campbell went to court when he was Opposition Leader, and lost.
The courts said First Nation rights are INHERENT and not DELEGATED. As
soon as he became Premier, he threw out the judicical decision, and the
relevant portions of the Constitution with it and went ahead with an
illegal referendum. As the eminent law man, Tom Berger said on Studio 4 TV
recently, all citizens should be very "troubled" about this action which
is "subversive of the rule of law". In quotes are his exact words.
This government is SUBVERTING THE CANADIAN CONSTITUTION. That should be
troubling to all citizens as it applies to a number of actions. Let's take
note of a few of the most obvious.
(1) Mark Hume apprised us of the unprecedented letter of nonconfidence
signed by all 146 provincial court judges. They refer to the violation of
the "principle of access to justice". Tom Berger noted the violation of
"the rule of law". By Constitution (Charter portion), "Canada is founded
upon principles that recognize the supremacy of God and the rule of law".
Failing to give access to justice to citizens and subverting the rule of
law. What kind of government does such a thing? A subversive government.
(2) Violating First Nation rights which are also entrenched in the
Constitution, as noted above.
(3) Executive decisions and administrative programs unprecedented in
Canada which deny the constitutional provision that "Everyone (who is
defined as a person under the law) has a right to life" (Charter, Section
7).
If you aren't troubled yet, you should be. And remember that they have had
less than one year to institute what looks like a systematic and well
thought out campaign to replace the Constitution with administrative
fascism. Is this what the citizens of BC voted for last year? Of course
not. But you know the old saying about giving them enough rope to hang
themselves. Soon there should be enough evidence that this gang
perpetrated electoral fraud as proscribed by Section 256 of the Election
Act. Then they can be removed under the 1996 Recall and Initiative Act.
They can ignore the courts and Constitution and the fundamentals of
justice but they will not ignore the vote. That is a power greater than
theirs.
According to VOBC TV last week, 55% of BC citizens would re-elect them
even today. But BCTV on April 22 reported a McIntyre and Mustel poll to
say that 54% would recall them. This is not so difficult to reconcile. The
55% is a "lesser of two evils" vote. The 54% is a hope for a better
alternative. I expect that a recall action at the same time that a
credible alternative candidate is put forward would be well received.
Given the margin of error for polls, the 54% willing to recall is about
the same as the 57% who voted for this gang initially.
