The argument came in a 64-page brief filed with the 4th U.S. Circuit Court of Appeals in Richmond. Hamdi is a Saudi national captured in Afghanistan in November. He was moved from Guantanamo Bay, Cuba, to a Navy brig in Norfolk when investigators learned he was born in Louisiana. Hamdi's father has been fighting to get a lawyer to see Hamdi, and a federal judge in Norfolk has twice authorized such a visit. But the appeals court stayed both visits. U.S. District Judge Robert G. Doumar ruled in August that a two-page Defense Department declaration was insufficient evidence that Hamdi is an enemy combatant. The Justice Department cited the separation-of-powers doctrine, arguing that the judiciary "lacks institutional competence" in determining whether a prisoner is an enemy combatant.
