alleging abuse by moving them out of court and into adjudication is to go before federal cabinet, sources say. If approved, the deal could see dozens of retired judges or other qualified arbiters weigh evidence and make rulings out of court...There would be smaller payments for relatively minor assaults but up to $100,000, or more, for the most serious physical and sexual abuse. Ottawa would pay 70 per cent of validated claims which some estimates say could top $1 billion. Victims would have to look to the Catholic, Anglican, United and Presbyterian churches that ran the government schools for most of the past century for the rest. Ottawa would also pay a portion of legal fees for plaintiffs who reach settlements, the sources said in confidence. The hope is that adjudication could, within seven years, resolve 75 per cent of cases now jamming an already stressed legal system.  Calls to Indian Residential Schools Resolution Canada, the federal office handling the lawsuits, were not returned. About one lawsuit a day is being resolved out of court with average payouts of $100,000. Hundreds more could drag on for decades.
Ottawa has paid more than $37 million in compensation for about 600 out-of-court settlements since 1996. Proponents of the adjudication plan say it is Ottawa's effort to fast-track cases and ease litigation trauma for more than 12,000 plaintiffs alleging physical and sexual abuse.

Code 340.1 - Summary: Civil claims must be filed within 8 years of the victim reaching the age of majority or "within three years of the date the plaintiff discovers or reasonably should have discovered that psychological injury or illness occurring after the age of majority was caused by the sexual abuse."  An amendment enacted in July of 2002 provides "actions may be commenced on or after the plaintiff's 26th birthday if the person or entity against whom the action is commenced knew, had reason to know, or was otherwise on notice, of any unlawful sexual conduct by an employee, volunteer, representative, or agent, and failed to take reasonable steps, and implement reasonable safeguards, to avoid future acts of unlawful sexual conduct. The bill would revive a cause of action solely for those claims for a period of one year, except as specified." Priest, Miami diocese named in clergy sex abuse lawsuit By Knight Ridder, 11/10/02 Fort Lauderdale, Fla. - "A 14-year-old boy was taken from his home in Cuba 40 years ago, brought to South Florida under the protection of the Catholic Church and repeatedly raped by a priest, according to a lawsuit filed in Miami-Dade Circuit Court on Friday.  The suit, which lists no monetary damages, names the Rev. Joaquin Guerrero and the Archdiocese of Miami as defendants, saying the archdiocese failed to protect the boy from sexual abuse. Now a 54-year-old social worker in Miami, the alleged victim, identified in the lawsuit as ''R.E.,'' came to the United States in 1962 under the Pedro Pan program, sponsored by the archdiocese to provide a better life for Cuban children." Bush Authorized Yemen-Style Strikes, Rice Says By Todd Eastham WASHINGTON (Reuters) - President Bush has given broad authority to "a variety of people" in his administration to launch attacks like the missile strike that killed six suspected al Qaeda operatives in Yemen last week, his national security adviser said on Sunday. "The president has given broad authority to a variety of people to do what they have to do to protect this country," national security adviser Condoleezza Rice told the television show Fox News Sunday. "It's a new kind of war. We're fighting on a lot of different fronts."

Human rights group Amnesty International wrote to Bush on Friday to question Washington's role in the attack. 'EXTRA-JUDICIAL EXECUTIONS' "If this was the deliberate killing of suspects in lieu of arrest, in circumstances in which they did not pose an immediate threat, the killings would be extra-judicial executions in violation of international human rights law," the London-based rights group in a statement. Amnesty called on the United States to issue a clear and unequivocal statement that it does not sanction extra-judicial executions. Rice seemed to reject that call on Sunday. "I can assure you that no constitutional questions are raised here," she said when asked if such killings violated U.S. or international law. The president is "well within the bounds of accepted practice and the letter of his constitutional authority," Rice said.
