Molest cases a test of statute of limitations Bob Egelko 12/3/02 "Withdozens of California child molestation cases at stake, the U.S. Supreme Court agreed Monday to review the state's law that allows criminal charges to be filed decades after the alleged sexual abuse occurred. The justices agreed to review a case involving Marion Stogner, a former Antioch resident who in 1998 was charged by Contra Costa prosecutors with molesting two of his daughters from the mid-1950s to the 1970s. The case has not yet gone to trial, and Stogner is free on bail. The statute of limitations in California -- the deadline for filing charges -- was six years at the time and has since been extended to 10 years. Iraq Urges Security Council to Halt US-British "Terror" in No-fly Zones
from Agence France Presse on Monday, December 02, 2002 FARUK SHUKRI BAGHDAD - Iraq urged the UN Security Council on Monday to intervene to force the United States and Britain to halt their "terrorist aggression" in "no-fly" zones which claimed the lives of four Iraqis the previous day. "We request the Security Council to perform its duties in keeping with Article 39 of the (UN) Charter ... to stop this barbaric and terrorist aggression," Foreign Minister Naji Sabri wrote in a letter to UN Secretary General Kofi Annan. Sabri said Sunday's air strike on the southern port city of Basra by US and British warplanes that enforce air exclusion zones in the south and north amounted to "a new US-British crime" that is part of an escalation of air raids in the "illegal" zones. The strikes aim at "destroying (Iraq's) economic and oil infrastructure and its food warehouses," said Sabri in the letter, a copy of which was obtained by AFP. Baghdad said four Iraqis were killed and 27 injured when coalition aircraft struck civilian installations in Basra and two other southern provinces on Sunday. Residents said the strike targeted the premises of the Southern Oil Company in Basra, 560 kilometers (350 miles) south of Baghdad. According to the US Central Command, the raid targeted an Iraqi air defense site and was in retaliation for Iraqi anti-aircraft fire against allied planes.

(12-01) 11:25 PST LOS ANGELES (AP) -- For five years, Oliverio Martinez has been blind and paralyzed as the result of a police shooting. Now the 34-year-old farm worker is at the center of a U.S. Supreme Court case which could determine whether decades of restraints on police interrogations should be discarded. The blanket requirement for a Miranda warning to all suspects that they have the right to remain silent could go into the rubbish bin of legal history if the court concludes that police were justified in aggressively questioning the gravely wounded Martinez while he screamed in agony.

One of the first attacks in the United States with mysterious origins abroad was the car bombing that killed Orlando Letelier, a Chilean, and Ronni Moffitt, an American, in 1976. This attack by the Chilean junta may have been a part of Operation Condor, an initiative by South American dictatorships to track and kill their opponents in exile. Kissinger knew about Operation Condor, yet he did not try to stop it. Anyone with such a record should not be on the commission.

The Bush administration is developing a parallel legal system in which
terrorism suspects -- U.S. citizens and noncitizens alike -- may be
investigated, jailed, interrogated, tried and punished without legal
protections guaranteed by the ordinary system, lawyers inside and outside
the government say.
The elements of this new system are already familiar from President Bush's
orders and his aides' policy statements and legal briefs: indefinite
military detention for those designated "enemy combatants," liberal use of
"material witness" warrants, counterintelligence-style wiretaps and
searches led by law enforcement officials and, for noncitizens, trial by
military commissions or deportation after strictly closed hearings.
Only now, however, is it becoming clear how these elements could
ultimately interact.
For example, under authority it already has or is asserting in court
cases, the administration, with approval of the special Foreign
Intelligence Surveillance Court, could order a clandestine search of a
U.S. citizen's home and, based on the information gathered, secretly
declare the citizen an enemy combatant, to be held indefinitely at a U.S.
military base. Courts would have very limited authority to second-guess
the detention, to the extent that they were aware of it.
