The Lovenstein Institute IQ Report
In July 2001 an e-mail began to circulate around the internet claiming that the Lovenstein Institute, a think-tank based in Scranton, Pennsylvania, had conducted research into the IQ of all the Presidents of the past 50 years and concluded that George W. Bush ranked at the bottom, with an IQ of only 91. This news quickly gained attention from the international media. The London Guardian broke the story on July 19, and on August 26 Garry Trudeau featured the report in his Doonesbury comic strip. Unfortunately both Trudeau and the Guardian had been taken in by a hoax. The e-mail had originated as a joke on a website called linkydinky.com. In its original version, the joke was evident. For instance, Linkydinky.com cited the Pennsylvania Court Observer as its source for the news, but this paper was simultaneously described as having a circlation of only five readers. Furthermore, Dr. Lovenstein was described as "living in a mobile home in Scranton, Pennsylvania." As the joke began to make its way through people's e-mail, these textual clues were removed, making it appear that the Lovenstein Institute was an actual research organization. Once they learned of their mistakes, both Trudeau and the Guardian published retractions.

The sweeping guidelines try to fix something that isn't broken.
Both traditional access to paper copies of court records and electronic access to records are not currently problematic and do not need fixing. Courts currently allow participants in the court process to request sealing orders when they can show a legitimate need for secrecy.
The model guidelines encourage states to consider further limits on access even to records at the courthouse by taking state statutes that may allow restrictions of particular information in certain circumstances and including them in a list of items that will be automatically excluded from public access. Access advocates should make sure that any lists of information or records proposed for automatic exclusion from access include only items that truly are categorically exempt under existing state law. For instance, if a state law says that crime victims can ask a judge to redact certain identifying information from records, do not allow the new access rule to include a complete restriction on all identifying information.....The guidelines ignore the fact that there is a right of access to court records, based on the First Amendment and the common law. There is a well-established principle that court records are presumed to be open to the public. Records are available unless, in a particular instance with regard to a particular record, a person can prove that there is a compelling interest requiring secrecy and that secrecy is the least restrictive means of achieving that interest. See, e.g., U.S. v. McVeigh, 119 F.3d 806 (10th Cir. 1997). The standard is high and records should not be cut off from public access based on mere allegation of "privacy," "embarrassment" or some other vague assertion of potential harm.

WASHINGTON (Dec. 6) - In the worst case, a war with Iraq could cost the United States almost as much as the government spent in the last budget year - nearly $2 trillion, according to new projections.
Researchers concluded in a study released Thursday that war with Iraq could cost the United States from $99 billion to more than $1.9 trillion over a decade. The lower figure assumes a successful military, diplomatic and nation-building campaign; the higher figure assumes a prolonged war with a disruption of oil markets and a U.S. recession, the authors say in a study by the American Academy of Arts and Sciences. Both figures assume a U.S. involvement in the country for 10 years.
