Knowing nothing more than the details in the report I have
two observations on this case.
Firstly, the judge seems to have applied an unusual amount
of common sense with regard to his comments. As I
understand it the right to defence of property and person
derive from common law (Blackstone). The Judge's common
sense contains great clarity and is a highly commendable
way of thinking for a Judge. It re-enforces the fact that
the reality of human existence is that everyone, whether
they would admit it or not, would want and probably
automatically invoke this right, in the appropriate
circumstances. And in any case this right is not one that
can be denied another human just because someone may find
the thought of it 'socially' unacceptable, or because of
some attempt to be seen as PC.
Secondly, the right to defend oneself is the same for
everyone. In the report the victim has his use of his
right to defend himself fully vindicated, unfortunately
he then does not seem too keen to accept that Martin had
(and still has) that right as well. With respect to that
right everyone is the same, the only difference being the
circumstances in which the right is used. It is very
interesting that even at the point of 'distancing' himself
from any comparison with the Martin case, he shows a
level of understanding. As a court should be made up of
'our peers' what would have been the verdict in the Martin
case if all the jury had had the experience of Mr. Achilleos???????
