It would appear, from the article below, that police can use their 
discretion - "This discretion is a fundamental principle in all aspects of 
policing".

I presume 33 mph is allowed in a 30 mph zone to allow for speedo error and 
is not discretion, but 38 mph at night clearly is.

New speed enforcement guidelines

Due to the pressure brought by safety campaigners Transport 2000, ACPO has 
revised its directions with regard to speed enforcement.
This means that a driver doing 33mph outside a school could now receive a 
court summons yet the same motorist travelling at 38mph outside the same 
school, but at midnight, might only receive a fixed penalty notice.
Ken Williams Chairman of the ACPO Traffic Committee and Chief Constable of 
Norfolk Constabulary, said: �The Guidance ACPO issues to its members is 
constantly being monitored and revised.
�The text of our guidance to chief constables on the prosecution of speeding 
offences has been amended since to give proper emphasis to the important 
part that discretion plays within the decision-making processes of 
patrolling officers.
"This discretion is a fundamental principle in all aspects of policing.
�As a result, the document now provides clearer guidance to the police on 
the need for enforcing speeding offences strictly but fairly, and to the 
public on the risks of facing formal action at illegal speeds which are 
close to the legal limit.
�The substance of the guidance issued in February this year otherwise 
remains the same and
there has been no reversal of the basics of our approach. Our aim is to 
police the roads in the most effective way possible to reduce the number of 
casualties caused by speeding and other factors.
�We are grateful to Transport 2000 for the invaluable advice and assistance 
they provided in the presentation of our guidance.�
Transport 2000�s Lynn Sbman said: �Tougher enforcement will save lives. 
Britain has one of the worst child pedestrian death rates in Europe, with 
nearly 100 children killed or seriously hurt every week.
�In order to cut this dreadful toll we need drivers to reduce their speed.�
All of this has come at an embarrassing time for the Home Office following 
the Home Secretary�s Special Branch driver being caught speeding at 103mph 
on the M5.
