As far as the police are concerned under CoER 1991 they are granted
powers by Regulation 15 (Enforcement). The guidance for reg 15 states
that enforcement of most the regulations is by the chief officer of
police. Licensed factories, magazines and mines are the responsibility
of HSE.
Enforcement by the police is by officers appointed as inspectors for
this purpose under section 19 of the HSW act 1974. These officers are
given powers under section 20 of the 1974 Act, including entry powers,
to carry out their duties under the regulations. However, such an
officer will not normally enforce the power of entry into domestic
premises where explosives are kept for private use, except in a
situation which, in his opinion, is or may be dangerous, or where there
is reason to believe there is a contravention of the regulations.
However, where gunpowder, or other propellant for small arms requiring
an explosive certificate, is kept in domestic premises, an inspection of
security arrangements may be necessary.
