His claim that he had shot at them from halfway down the
stairs was disproved by scientific evidence that showed he must have
fired his illegally-held, pump-action shotgun from the doorway of a
downstairs room.
The prosecution accused him of angrily lying in wait for the
burglars and opening fire, without warning, from close range in
retribution for previous robberies at his home.

From a previous post by INTERNET:[EMAIL PROTECTED]:

There, they had been confronted by dogs.
They retreated towards what they thought was a wood but what turned
out to be Bleak House.
As they stumbled around in the dark they were confronted by
an "old man".
"I seen what I thought was a torch. Saw a flash," said
Fearon. "I heard Fred say, `he got me!'

Scientific evidence, their arses!
If the old man shot at them from the hallway at the junction
of the stair well and the adjoining hallway, then he shot at them as
he said.
The whole charade of what passes as 'evidence' as far as I
can see, is as biased as it gets. They 'retreated' to a house that
they had to literally break into, by removing the bars.
Isn't that kind of like breaking into a jail?
And, to address a remark made earlier by Neil Francis,

Why all this martyr style defense of Tony Martin?
He killed a kid - he had an illegal firearm - did he not
take a pot shot at a delivery driver some time in the past or did
I hear this wrong.

You are making too many excuses here.
What, I'd like to ask, would you have said if Fearon had
decided to pack along a baby in a pack, and the baby got shot?
In my nation, there is such a thing as reckless
endangerment, which, if you need a definition, is the thoughtless
and irresponsible actions on the part of the principal actor which
leads to the injury or demise of another. And, just so we understand
who was acting recklessly, it wasn't Tony Martin.
You are assessing blame on the wrong person.
It seems to me that Fearon decided to break the law by
entering private premises - exacerbated by the night time entry!
What was Martin supposed to do? Help them by lighting
their way?
And, as far as I am concerned, there the is no such thing
as an 'illegal firearm' - especially in your country, more so than in mine.
But, that's a matter for you to resolve, isn't it?
