The U.S. Securities and Exchange Commission recently announced a settlement
with DraftKings over charges arising from posting material nonpublic
information on the CEO's social media accounts, highlighting that
information posted to company websites and social media sites does not
automatically qualify as "publicly disclosed" for purposes of Regulation
FD, say attorneys at O'Melveny.
