Given that Jim Choate has a different view of events and the purpose of the list to it seems just about everyone else, why don't we just disconnect his lists from the other lists, then he and perhpas mattd and a few other noisy types can go inhabit Jim's list and Jim will surely be content to keep posting to the Choate version of the cypherpunks list.
Then we will just let the market decide. Between the [CDR] prefix and the insessant one liners and the changing email addresses so he keeps popping up out of your filters, and that he creates such a nuisance that people discussing the nuisance he's caused also cause the topic to inevitably spill out of kill files, I think it would be a net positive, and presumably amenable to Jim also as he claims some kind of proprietorship over his node.
