The Australia High Court's ruling that allows a Melbourne businessman to sue Dow Jones in Australia over a Barron's article published in the U.S. and distributed via the Internet effectively "puts at risk the ability of Americans to speak with each other and be protected by American law when they do so," says attorney and First Amendment specialist Floyd Abrams. The court's attempt to narrowly define "publishing" as the place where the download occurred doesn't make sense in a world where media companies such as Dow Jones have assets world-wide, he says.
