The claim in question [1] was "The author of the Eclipse darcs plugin is legally disallowed from shipping a version of darcs that comes with the CPL'ed Eclipse darcs plugin.". You are right that this claim is far too strong. I should have said "The author of the Eclipse darcs plugin cannot be certain that he is legally allowed to ship a version of darcs that comes with the CPL'ed Eclipse darcs plugin.". Indeed, based on his statements [2], Leif Frenzel, the author of the plugin, appears to believe that he is disallowed from doing so. Unfortunately, this is a matter of opinion. Fortunately, one of the opinions that matter most is David Roundy's, and he has strongly and unequivocally stated that he intends for this to be okay [3]. It would be nice if Leif Frenzell and other Eclipse hackers such as the Yoxos folks [4] will take David's word for it and start bundling darcs with every copy of Eclipse. But it may require some more legally binding statement before they do that.
