Eish, not good, but I don't know ... I know from experience that when the quick release does come loose sometimes and one does not always "notice it", though that said you can just feel that something is not quite right.
>From the sounds of it, the kind-of mountain biking this bloke was doing is pretty intense and these will tend to happen if you don't maintain and do a brief inspection before you ride. If he was riding down a peaceful single track and did a small drop-off or something and the quick release came loose, then sure Fox is at fault because of faulty equipment (and he would probably have eventually picked up on it before he bailed), but it is a different story when you doing some serious s.hyt on your bike and pushing your equipment.
