Any Debian init script is affected by this bug. If you kill the process in a way that the PID file is not removed, start-stop-daemon will complain. Improving the PID file handling in samba won't change that materially because kill -9 won't be affected by that. The question is perhaps whether s-s-d should be so chatty in this regard, but that is not a question that can be answered here.
