yes, the bug is just fixed in HEAD, but no, nobody should/will backport the patch, until the kernel becomes stable (rc1 is not enough), and a new stable virtualbox is released. As you can see the patch in the upstream tracker [1] the kernel is going in a deadlock with the patch, so everything should be fixed between kernel and/or virtualbox. Fixing this stuff in debian is just useless.
