Looking closer at kodi it turns out it has a -l /--lircdev CLI option. problem solved. This also means that thomas can walk-around the problem by configuring kodi instead of using the symlink.

Which means that the only thing thing required is to make kodi use /run/lirc/lircd as default, simplifying the normal usecase. I was mislead by the "hardcoded" statement. After all, nothing is hardcoded here, it's just a question of defaults.
