I don't know when this started, but this package is based on the sdists from pypi which currently do not contain the tests. So the tests aren't run during build, and we don't find out that e.g. the legacy submodule is broken by Python 3.10. I think packaging from upstream git is probably the way to go here (I remember some discussion about this general issue but I don't remember the conclusion!).
