I'm confused. Why would you think a fix for kernel 2.6.5 would apply to problems compiling with the (very new) 2.6.16 kernel? You should unapply the patch you applied and try the patch from bug #368541, <http://zbla.net/debian/nvidia-graphics-drivers-legacy-1.0.7174-2+rlimfix+sarge0/nv-legacy-linux-2.6.16.patch>. That works for me.
