Still seeing this problem.
Also, atd may be running, but pidfile isn't there. In such situation the
init script fails to kill atd and start a new atd process:

-bash-3.1# /etc/init.d/atd restart
Stopping deferred execution scheduler: atd.
Starting deferred execution scheduler: atd.
-bash-3.1# ps axww -H|grep atd
3469 pts/0    S+     0:00         grep atd
4160 ?        Ss     0:00   /sbin/rpc.statd
3408 ?        Ss     0:00   /usr/sbin/atd
3456 ?        Ss     0:00   /usr/sbin/atd
    
clearly, the script should be a bit smarter.
But this seems a common problem with Debian's init scripts, ie if pidfile
isn't found then daemon wasn't running for sure. Turns out to be wrong.
