I finally upgraded to kernel 2.6, then the upgrade to mysql-5.0.38 worked well.

in that case, perhaps that apt-get should throw a dependance error, instead of 
trying to install ?

But how to make a dependency against the running kernel? Someone can have 
kernel-2.6 installed
but still have booted a self compiled 2.4 kernel? Or even has 2.6 but self 
compiled.
