This does not happen if you set EDITMOTD in /etc/default/rcS:

# Set EDITMOTD to "no" if you don't want /etc/motd to be editted
# automatically
EDITMOTD=yes

? They are applied after every reboot. As this is implemented in bootmisc.sh.
This phrase might need to be rewritten.
