well, with the -5 package the init.d script tries to do the right thing
(tm) by default.

when the default speed is set to 0 the script avoids using the --max/min
options to cpufreq-set so this chouldn't be a problem in itself

hmmm... it sounds like you have a very old config file hanging around.
What happens if you remove (or rename) the cpufrequtils default file and
restart the init.d script?
