Seeing as how similar packages (e.g. nvidia-kernel-source, ipw3945-source, ivtv-source, squashfs-source, kqemu-source, etc.) all depend on dpatch and how acx100-source will not be particularly useful as a package without dpatch installed (the definition of depends), and dpatch is not needed to build the acx100-source package (afaik), I strongly encourage you to depend on dpatch rather than build-depend on it.
