Sorry, but that is just not correct.
Obsolete conffiles should be removed by the maintainer scripts.

In this case I think that it would be OK to remove the file even if the user 
had modified it (which is extremely unlikely in this case). Reason: the 
file cannot possibly have any function on the system if modutils is not 
installed.

Please check with, for example, Steve Langasek if you would like 
confirmation (note: he may not necessarily agree with the last paragraph).
