$ emacs23 -q test.sh
emacs23 does highlight `date' as a program name as if it was outside the
comment.
In standard sh mode (using `#!/bin/sh' as a first line) date is not highlighted,
as expected.
PS. emacs22 version 22.3+1-1.1 behaves likewise.
