just installed the old kernel again (debian does its magic to have a dual boot now) and my battery (the newer one with about 7.9Wh) will work again. so, must have something to do with the newer kernel, not smapi, tp_smapi for kernel 2.6.26-1 is currently not installed or loaded. so on my machine, t42p: 2.6.26-1:works, 2.6.26-2: fails, on a friends machine, t42: both 2.6.26 worked.
