Please go and read the Debian policy 1.1:

Non-conformance with guidelines denoted by should (or recommended) will
generally be considered a bug, but will not necessarily render a package
unsuitable for distribution.

This is a bug and should be fixed. And it is actually easy to do so, please stop
being lazy. Hint: You could create the copyright file in the clean target in
case it is not there.
